My daughter works in HR and unfortunately a company can let you go within two years just by saying that your work ethic is not up to their standards.

There’s a probation period usually of three or six months when an new employee needs to prove their standard of work and ability is up to the required standard for their position. Once they have passed probation, they can’t be dismissed just like that and are entitled to a full range of benefits including sick pay, bonuses, pension, private medical insurance, etc. I’m not clear of this two year stipulation, I thought once you’ve passed probation you simply can’t be dismissed just like that. I don’t work in HR myself.

Probation or not, employers can easily sack someone (excluding public sector). They know the vast majority of people will not take it further or do anything about it.

It's now 2 years instead of one when an employer can be taken to a tribunal for unfair dismissal.kancutlawns wrote:ikhlaq786 wrote:sjbarca wrote:Seems illegal to me!m4rkb wrote:What a disgraceful attitude your 'boss' had and a disgraceful way to conjure up a cheap excuse to get rid of you. Hmm, that's not really accurate.
They still have to put procedures in place - ie they can't just say cheerio with no prior warnings/meetings etc
Once you've got through your probation period, it is actually quite hard to sack someone.
Was your probation period two years?

Re: Just Lost My Job.
It is true. You cannot go to a tribunal for unfair dismissal for 2 years, it used to be one, but they changed that in 2016.
That effectively gives an employer carte blanche to do whatever they want if they're a cunt.
I've said this in other threads, but idiots were focusing on completely fair zero hour contracts while very damaging new rules were passed.

That’s exactly what I think. If it’s a large established organisation like VW then they are bound by proper disciplinary and employment regulations as are I guess small companies. There is a probation period that any new employee needs to get through when they have their objectives reviewed constantly. Once they pass it, they can’t be dismissed just like that, it doesn’t sound to me like Ikhlaq was on a zero hour contract.
I would have thought the union or Business Partner would be over this case like a rash. This two year thing sounds like a red herring. This is a motor manufacturing company, Ikhlaq and very probably heavily unionised so take it to them. You can make a position redundant but not a person. There needs to be a proper redundancy procedure implemented with a committee, a ninety day consultation and then staff who are at risk notified where they can take either voluntary or compulsory redundancy.
Look into it Ikhlaq, it sounds rather suspect to me. After probation, you are entitled to a full range of benefits and employment. You have rights and don’t need two tears otherwise what’s the point of the probation? If employers want to fuck their staff over, what would stop the employee leaving within the two year period and walk out with no notice? That’s what regulations are there for to protect staff.

Re: Just Lost My Job.
Right, at the risk of looking at utter lemon and contradicting in part what I wrote previously, there is some ahem supplementary info that adds light to the OP’s redundancy. I am reliably informed by Mrs L who knows about employment law that within the first two year period (on passing probation), the person is regarded as a worker but not an employee hence doesn’t have full employee rights. Whilst being employed, he/she can be dismissed as has happened to Ikhlaq. If the matter goes to Tribunal, the organisation can hedge their case in such a way that they can put the dismissal down to poor performance and the tribunal would come down on their side rather than on the side of the worker.
It’s a pretty shit state of affairs. Apologies, I guess this just reinforces what others have said here but my better half told me the legal standpoint.

Re: Just Lost My Job.
DOnt you get it? They removed your rights while they were pretending zero hour contracts were the problem! They knew nothing would ever come of complaining about that, because they are completely essential for any business to make any money and work sensibly.
By law, you all had a years probation in the governments eyes, companies can say what they like about 3 month probationary periods, but if they renaged on that 11 months in, you wouln't be able to take them to a tribunal about it, unless they withheld moneies owed.
But now its two years. Because fuck you, big business gets what it wants.
